GAME OF CHANCE - COMPETITION TERMS AND CONDITIONS 

These are the terms and conditions of a competition promoted by:  

My Pay Now Pty Ltd ACN  635 410 909 PO Box 823 Surfers Paradise QLD 4217 (“the Promoter”).  

Start date: Saturday 9th March 2024 12:00 pm AEST 

End date: Monday 18th March 2024 12:00 am AEST 

Eligible entrants: Entry is open to permanent residents of Australia aged 18 years of age and over. All eligible entrants must be following MyPayNow and the Gold Coast Titans on Instagram, like the competition photo, and tag 1 person in the comments. The winner and nominated friends who will claim the prize must be over 18 years of age and permanent residents of Australia. 

Ineligible: Employees (and the immediate family members) of agencies/companies directly associated with the conduct of this Promotion, the Promoter, its distributors, suppliers, subsidiary companies/businesses and associated companies and agencies are not eligible to enter. "Immediate family member" means any of the following: spouse, ex-spouse, de-facto spouse, child, or stepchild (whether natural or by adoption), parent, stepparent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, stepbrother, stepsister, or 1st cousin. 

Total Prize Pool: 

The winner of the Major Prize (dugout seating) will be randomly selected at the MyPayNow office on Monday, March 18th, 2024 at 9:00 am AEST. The winner will be contacted via @MyPayNow Instagram at 9:30 am AEST. 

The winner will be contacted on Instagram via direct message on Monday 18th March 2024 at 12:00 pm AEST. Direct messages from MyPayNow will only be requesting names and contact information to take the conversation off social media. No sensitive information will be collected over social media. Upon being notified, winners must claim their prize by replying to the Promoter with their name and contact information. When the Promoter emails the winner, the winner must also provide identification to confirm their name and age.  

Unclaimed Prizes: 

The winner of the Major Prize must claim their prize by 12:00 pm AEST on Tuesday the 19th of March, 2024. This is 24 hours from the time of the prize draw. In the event that the prize is not claimed by the deadline, a redraw will take place at 1:00 pm AEST on Tuesday the 19th of March, 2024, using the same method as the original prize draw. The winner of the redraw will be contacted via the @MyPayNow Instagram account at 1:30 pm AEST and will be notified in the same manner as the original winner notification on Wednesday, March 20, 2024. 

1. The entrant agrees and acknowledges that they have read these Terms and Conditions of Entry and that entry into the Promotion is deemed to be acceptance of these Terms and Conditions. 

2. The Promotion commences on the Start Date and ends on the End Date ("Promotional Period"). Entries are deemed to be received at the time of receipt by the Promoter and not at the time of transmission or deposit by the Entrant. Records of the Promoter and its agencies are final and conclusive as to the time of receipt. 

3. Valid and eligible entries will be accepted during the Promotional Period. 

4. Entry is only open to Australian residents ages 18 years or over. 

5. Draw: 

a) The draw will take place at the times nominated above and will be conducted by a draw conductor nominated by the Promoter.  

b) The draw will take place at the premises of the Promoter. 

c) The draw conductor may draw additional reserve entries in case an invalid entry or entrant is ineligible. 

d) If a draw is scheduled on the weekend or a public holiday, the draw will be conducted at the same time and location on the following business day.  

e) The winner of a drawn prize is determined by chance. 

f) Multiple entries are permitted, subject to the following: (a) only one (1) entry is permitted per tag regardless of the number of tags on the same Instagram handle; and (b) each entry must be submitted as a separate Instagram handle in accordance with the entry requirements. No spam, business or fake Instagram handles will be accepted as entries.  

g) The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant's identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual whom the Promoter has reason to believe has breached any of these Terms and Conditions,  tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion.  

h) The Promoter will ensure each draw is open for public scrutiny anyone can request to view the certificate of compliance. 

6. All reasonable attempts will be made to contact the winner. 

7. If the winner chooses not to take their prize (or is unable to) or does not take or claim the prize by the time specified by the Promoter, or is unavailable, they forfeit the prize, and the Promoter is not obliged to substitute the prize. 

8. The winner must be able to attend Cbus Super Stadium, Centreline Place, Robina, QLD, 4226 on the 30th of March 2024 to the Gold Coast Titans VS Dolphins – Round 4 match . Travel to the location is the responsibility of the winner. 

9. The winner must send confirmation of names and confirmation of attendance to the game by Monday 25nd March 2024. The winner will forfeit the prize if the promoter does not receive a confirmation by this date. 

10. No entry fee is charged by the Promoter to enter the Promotion. Where entry is allowed online, there is no additional cost to enter the Promotion other than any cost paid by the entrant to access the website or social media platform of entry via their Internet service provider. 

11. All Entrants' personal information will be collected, stored, and used by the Promoter in accordance with its Privacy Policy available on the Promoter’s website, www.mypaynow.com.au. The Promoter may use this information for future marketing purposes regarding its products, including contacting the entrant electronically.  

12. If for any reason any aspect of this Promotion is not capable of running as planned, including by reason of computer virus, communications network failure, bugs, tampering, unauthorised intervention, fraud, technical failure or any cause beyond the control of the Promoter, the Promoter may in its sole discretion cancel, terminate, modify or suspend the Promotion and invalidate any affected entries, or suspend or modify a prize, subject to State or Territory regulation. 

13. The Promoter reserves the right, at any time, to validate and check the authenticity of entries and entrant's details (including an entrant's identity, age, and place of residence). In the event that a winner cannot provide suitable proof as required by the Promoter to validate their entry, the winner will forfeit the prize in whole and no substitute will be offered.  

14. Incomplete, indecipherable, inaudible, incorrect, and illegible entries, as applicable, will at the Promoter's discretion be deemed invalid and not eligible to win.  

15. The use of any automated entry software or any other mechanical or electronic means that allows an individual to automatically enter repeatedly is prohibited and may render all entries submitted by that individual invalid. 

16. The Promoter reserves the right to disqualify entries in the event of non-compliance with these Terms and Conditions. In the event that there is a dispute concerning the conduct of the Promotion, the decision of the Promoter is final and binding on each entrant and no correspondence will be entered into by the Promoter with any claimant.  

17. The Promoter and its associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person's negligence or wilful misconduct) in connection with this Promotion or accepting or using any prize (or recommendation), except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law). 

18. All prizes are non-transferable and not redeemable for cash. 

19. This game of chance is in no way associated with Instagram. 

20. The promoter and the Gold Coast Titans reserve the right to change the chosen event date for any reason, including but not limited to, player wellness, sickness, government or sporting regulations, weather etc.
