GAME OF CHANCE - SURVEY TERMS AND CONDITIONS
These are the terms and conditions of a competition promoted by:
My Pay Now Pty Ltd ACN 635 410 909 PO Box 823 Surfers Paradise QLD 4217 ("the Promoter").
This Promotional Competition
Promotional Period:
Start Date: 27th November 2024 10:00 am AEST
End Date: 20th December 2024
The Promoter may close the promotion and survey before the End Date if the maximum number of responses is received earlier.
Eligible entrants: Entry is open to permanent residents of Australia aged 18 years of age and over who have participated in the MyPayNow online survey. Entry is open to the first 15,000 survey responses in the timeframe outlined above.
Ineligible: Employees (and the immediate family members) of agencies/companies directly associated with the conduct of this Promotion, the Promoter, its distributors, suppliers, subsidiary companies/businesses and associated companies and agencies are not eligible to enter. "Immediate family member" means any of the following: spouse, ex-spouse, de-facto spouse, child, or stepchild (whether natural or by adoption), parent, stepparent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, stepbrother, stepsister, or 1st cousin.
How to enter: Eligible entrants must:
- answer all questions in the MyPayNow online survey;
- manually opt-in at the end of the survey by selecting the relevant check box;
- andprovide their full name and email address.Multiple entries are not permitted.

Draw details
Prize will be drawn by random selection at the MyPayNow office located at 50 Cavill Avenue, Surfers Paradise QLD 4217 on Thursday 2nd January 2025 at 12.00pm AEST.
Winner notification:
The winner will be notified by email on Thursday 2nd January 2025 where they will be required to provide proof of age and identity in the form of a driver's license or proof of age card. Once the winner's age and identity has been confirmed, MyPayNow will send 2 x $500 e-gift cards to the prize winner.
Unclaimed Prizes:
The Prize must be claimed by Monday 6th January 2025 5.00pm AEST. If the winner does not respond to the email notification or fails to provide the required identification or information within the date and time outlined above, the prize will be considered unclaimed. In that event, the prize will be redrawn on Tuesday 7th January 2025 12.00pm AEST by the same method as above. The winner of this redraw will be notified by email as per above "winner notification" on Tuesday 7th January 2025.
General Terms and Conditions
1. The entrant agrees and acknowledges that they have read these Terms and Conditions of Entry, and entry into the Promotion is deemed acceptance of these Terms and Conditions.
2. The Promotion commences on the Start Date and ends on the End Date ("Promotional Period"). Entries are deemed to be received at the time of receipt by the Promoter and not at the time of transmission or deposit by the Entrant. Records of the Promoter and its agencies are final and conclusive as to the time of receipt.
3. Valid and eligible entries will be accepted during the Promotional Period.
4. Draw:
a) The draw will take place at the times nominated above and will be conducted by a draw conductor nominated by the Promoter.
b) The draw will take place at the premises of the Promoter.
c) In the event of an invalid entry or ineligible entrant, the Promoter will perform a re-draw to determine the runner-up. The runner-up will be selected as the prize winner. This also applies if the initial prize winner fails to claim the prize within the specified time frame.
d) If a draw is scheduled on the weekend or a public holiday, the draw will be conducted at the same time and location on the following business day.
e) The Promoter will ensure the draw is open for public scrutiny and anyone may witness the draw on request.
f) The winner of a drawn prize is determined by chance
g) The online website "randomdraws.com.au" will be the platform used to conduct the draw. Email addresses and names of Participants who have willingly opted-in will be uploaded and used to draw the winner.
5. Winner Notification:
a) The winner will be contacted by email where they will be required to provide proof of age and identity in the form of a driver's license or proof of age card.
b) Once the winner's age and identity has been confirmed, MyPayNow will email 2 x $500 Eftpos e-gift cards to the Prize winner.
6. No entry fee is charged by the Promoter to enter the Promotion. Where entry is allowed online, there is no additional cost to enter the Promotion other than any cost paid by the entrant to access the website or social media platform of entry via their Internet service provider.
7. The first valid entry randomly selected from all valid entries received will win. The prize will be awarded to the person who both completed the survey and opted in to go in the draw to win the prize. If there is a dispute regarding the identity of the entrant or winner, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant or winner.
8. All Entrants' personal information will be collected, stored, and used by the Promoter in accordance with its Privacy Policy available on the Promoter's website, www.mypaynow.com.au. The Promoter may use this information for future marketing purposes regarding its products, including contacting the entrant electronically.
9. If, for any reason, any aspect of this Promotion is not capable of running as planned (including due to computer virus, communications network failure, bugs, tampering, unauthorised intervention, fraud, technical failure, or any cause beyond the control of the Promoter), the Promoter may, in its sole discretion, cancel, terminate, modify, or suspend the Promotion and invalidate any affected entries, or suspend or modify a prize, subject to State or Territory regulation.
10. The Promoter reserves the right, at any time, to validate and check the authenticity of entries and entrant's details (including an entrant's identity, age and place of residence). In the event that a winner cannot provide suitable proof as required by the Promoter to validate their entry, the winner will forfeit the prize in whole, and no substitute will be offered. The Promoter would then perform a re-draw to determine the runner up and new winner of the Prize.
11. Incomplete, indecipherable, inaudible, incorrect and illegible entries, as applicable, will at the Promoter's discretion be deemed invalid and not eligible to win.
12. The use of any automated entry software or any other mechanical or electronic means that allows an individual to automatically enter repeatedly is prohibited and may render all entries submitted by that individual invalid.
13. The Promoter reserves the right to disqualify entries in the event of non-compliance with these Terms and Conditions. In the event that there is a dispute concerning the conduct of the Promotion, the decision of the Promoter is final and binding on each entrant and no correspondence will be entered into by the Promoter with any claimant.
14. The Promoter and its associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person's negligence or wilful misconduct) in connection with this Promotion or accepting or using any prize (or recommendation), except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).
15. All prizes are non-transferable.
16. This game of chance is in no way associated with Survey Monkey.

MyPayNow Pty Ltd (the Company) may, from time to time, offer eligible existing customers (Referrers) the opportunity to refer friends, family, colleagues or other contacts (each a Referee) to the Company (RAF Program). These terms and conditions (RAF Terms) apply to the RAF Program.
By participating in the RAF Program, you agree to be bound by these RAF Terms and to use the RAF Program in the manner described in these RAF Terms.
1. Eligibility
1.1. To be a Referrer, you must have set up your account with the Company, including linking your bank account details to your account.
1.2. To be a Referee you must:
(a) not have held, at any time prior to being referred to the Company (Referral), an account with the Company; and
(b) satisfy the Company's eligibility criteria for use of its platform.
This means that if you have previously set up an account at any time, even if you did not take an advance, you will not be eligible to be a Referee.
1.3. Employees (whether temporary or permanent) or contractors of the Company or any of its related entities are ineligible to be Referrers or Referees.
2. How it works
2.1. To participate as a Referrer, refer your friends, family, colleagues or other contacts by sharing your unique link or code with them. You can find your unique link under the refer a friend tab in your account. You can share your link or code as many times as you like.
2.2. To participate as a Referee, you must:
(a) before the End Date, use the Referrer's unique link to create an account with the Company, including linking your bank account details to your account and be approved for an advance; and
(b) at some time thereafter, take an advance.
3. Referral Gift
3.1. Subject to the Referrer and Referee satisfying the criteria above, immediately after the Referee takes an advance, the Company will make a real time transfer of an amount of $50 (Referral Gift) into each of the bank account held by the Company for the Referrer and Referee.
3.2. For each Referee that utilises a Referrer's unique code and satisfies the criteria above, the Referrer will receive a Referral Gift. There are no limits to the number of Referral Gifts that a Referrer may receive.
3.3 If, as Referee, you fail to use the Referrer's unique link to create your account with the Company, neither you nor the Referrer will be entitled to any Referral Gift. The link cannot be retrospectively applied.
4. Changes and termination of the RAF Program
4.1. The Company reserves the right to modify or terminate the RAF Program at any time without prior notice to you. If these RAF Terms are modified, updated RAF Terms will be posted to the Company's website.
4.2.If the RAF Program is terminated prior to the Referee taking an advance, you will not be entitled to any Referral Gift.
4.3. The Company reserves the right to disqualify or terminate the involvement of any Referrer or Referee in the RAF Program if it reasonably suspects they have breached these Terms or become ineligible to use the Company's platform. If the Company does so, it reserves the right not to provide any Referral Gift to that person or any person in a Referrer-Referee relationship with that person.
5. Your participation in the RAF Program
5.1. You agree to use the RAF Program in accordance with these RAF Terms and in good faith.
5.2. You cannot refer yourself and you must respect the spirit of the RAF Program by only referring real individuals who meet the requirements of these RAF Terms. For example, you are prohibited from creating multiple or fake accounts with us or participating in the RAF Program using multiple or fake email addresses or identities. Any attempt to do so will result in your immediate disqualification from the RAF Program and disentitle you to use the Company's platform.
5.3. You are responsible for providing the full and accurate information to the Company for the purposes of setting up your account and participating in the RAF Program, including but not limited to contact, bank account and employment details.
6. Liability
6.1. The Company makes no representations or warranties that that the RAF Program will meet your requirements or that a Referee will be approved as a customer of the Company. All Referees are subject to the Company's usual eligibility requirements.
6.2. The Company relies on the account information provided by you being correct, including your bank account details. The Company accepts no responsibility for any failure to receive a Referral Gift because you provided incorrect bank account details or because you failed to update your bank account details in your account.
6.3. To the maximum extent permitted by law, the Company excludes liability for any direct or indirect loss arising out of or in connection with participation in the RAF Program, including but not limited to:
(a) loss of profit, opportunity, goodwill, or anticipated savings;
(b) loss or corruption of data;
(c) injury, loss or damage of any kind resulting from acceptance, possession or use of a Referral Gift;
(d) a Referee's failure to be approved as a customer of the Company; or
(e) a failure to receive a Referral Gift for reasons that are outside of our reasonable control.
6.4. The Referral Gift is a net payment. The Company is not responsible for any taxes payable as a result of the provision of the Referral Gift.
6.5. The Company reserves the right to use the Referral Gift to offset any amounts you owe it.
7. Privacy
7.1. All personal information provided in connection with the RAF Program will be collected, stored, and used by the Company in accordance with its Privacy Policy available on its website, www.mypaynow.com.au.
8. Governing law and Jurisdiction
8.1. These RAF Terms are governed by and construed in accordance with the laws of Queensland and any dispute arising from them shall be determined by the courts of that state.

Terms and Conditions
Promotion Period: 4 December 2024-31 December 2024
These terms and conditions (Prize Terms) must be read in conjunction with the Terms and Conditions which apply to the RAF Program (RAF Terms), which apply in addition to these Prize Terms.
Unless otherwise indicated, capitalised terms in these Prize Terms have the meaning given to them in the RAF Terms.
By participating in the RAF Program during the Promotion Period, you agree to be bound by these Prize Terms, in addition to the RAF Terms.
1. Overview
1.1. Referrers who participate in the RAF Program during the Promotion Period will be automatically eligible to win a share of $5,000 (Total Prize).
1.2. The Total Prize will be distributed among the three Referrers who refer the highest numbers of Referees during the Promotion Period, subject to meeting certain eligibility criteria.
2. Eligibility Criteria
Referrers who are eligible to win a share of the Total Prize (Eligible Referrers) are Referrers who are not:
2.1. immediate family members of an employee (whether temporary or permanent) or contractor of the Company or its related entities, where "immediate family member" means:
(a) a spouse (including former spouse), de facto partner, or domestic partner;
(b) a child, stepchild, or adopted child;
(c) a parent or step-parent;
(d) a sibling or step-sibling;
(e) a grandparent or grandchild;
(f) a person who permanently resides with that person;
(g) or the spouse, de facto partner, or domestic partner of any person referred to in paragraphs (b) to (e), or
2.2. disqualified or otherwise excluded from the RAF Program under the RAF Terms.
3. Total Prize
3.1. The Total Prize will be allocated as follows:
(a) $3,000 to the Eligible Referrer who makes the highest number of Eligible Referrals (as defined in clause 4 below) (First Place);
(b) $1,500 to the Eligible Referrer who makes the second highest number of Eligible Referrals (Second Place);
(c) and $500 to the Eligible Referrer who makes the third highest number of Eligible Referrals (Third Place).
3.2. In the event of a tie for First, Second, or Third Place, the Total Prize will be allocated based on time of achievement. In other words, the Eligible Referrer who achieved the result first in time will receive the highest available prize, and the Eligible Referrer who was next in time will receive the next lower-ranked prize.
4. Eligible Referrals
4.1. In order to constitute an Eligible Referral, the relevant Referee must take an advance during the Promotion Period.
4.2. Each time the Company deposits a Referral Gift to an Eligible Referrer during the Promotion Period on account of being a Referrer, that will count as one Eligible Referral for the purposes of calculating the number of Eligible Referrals by that Eligible Referrer.
5. Winner notification
5.1. The winners of the Total Prize will be determined on or before Friday, 10 January 2025.
5.2. On the date the winners are determined:
(a) winners will be notified by email; and
(b) the winners' names will be published on our website on the same date and for a period of at least 28 days.
5.3. The winners' respective shares of the Total Prize will be deposited into the bank accounts associated with their accounts with the Company. The Company is not responsible for the failure of any winner to receive their share of the Total Prize on account of having provided incorrect bank details to the Company or failing to update their bank account details as required.
