Terms of Use

These Terms of Use (“Terms”) form a binding agreement between MyPayNow Pty Ltd (ACN 635 410 909) (“we”, “us” or “our”) and the individual or entity (“you”) who accesses or uses our website (www.mypaynow.com.au), any subdomains, our mobile application (“App”) and any related tools, content and services (together, the “Service”). By creating an account, accessing, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.

1. Disclaimer

Unless stated otherwise, all content provided through the Service is for general informational purposes only. It does not constitute legal, financial or professional advice, and should not be relied upon as such. You are solely responsible for verifying any important information and obtaining independent advice appropriate to your specific circumstances before making decisions.

The information we provide on our website and App is provided in good faith, on an “as is” and “as available” basis and, to the extent permitted by law, without warranty.

We do not guarantee the quality, accuracy, suitability, completeness or reliability of the information or the Service. Opinions expressed should not be relied upon for decision-making.

2. Eligibility, acceptable use and enforcement

Our Service is for Australian residents aged 18 or over. By using the Service, you confirm you meet these requirements and agree to use it lawfully, respectfully and responsibly.

You must not:

  • provide false, misleading or incomplete information;

  • open or maintain more than one account, or open an account for someone else;

  • attempt to circumvent our eligibility checks, identity verification or risk controls;

  • use the Service for unlawful purposes or in a way that infringes others’ rights;

  • misuse the Service, attempt to gain unauthorised access, or interfere with the operation or security of the Service;

  • reverse engineer, scrape or data-mine the Service;

  • upload or transmit malware or other harmful code; or

  • do anything that could damage, disable or overburden the Service or our systems.

We may suspend, restrict or terminate your access to all or part of the Service at any time, without notice, if we reasonably believe you have breached these Terms or engaged in conduct that is unlawful, harmful or disruptive to us, our systems, or other users.

3. Identification and authorisation

If you create an account with us, we will ask you to provide an identity document (“ID”) to verify your identity before you can access certain features of the Service. If you take an advance, we may also ask you to provide or update bank account information to assess your eligibility.

By using the Service, you confirm that:

  • you are authorised to provide your ID and bank account details and to access and share your bank account information; and

  • you consent to us verifying your ID (including the personal information it contains) against official records.

You also authorise us and our third-party providers to collect, use and disclose your ID and bank account information for purposes connected with operating the Service, including identity verification, eligibility assessment, fraud prevention and compliance with law (including the Anti-Money Laundering and Counter-Terrorism Financing Act 2006 (Cth)).

When you provide your ID details, you authorise us to share that information with our third-party verification provider, and for that information to be securely stored to the extent reasonably necessary to operate the Service and meet our legal record-keeping obligations.

4. Third-party services and bank connection

We use third-party providers to perform functions such as identity verification, data analytics and bank connection. These providers may retrieve and analyse your information and, where necessary to operate the Service, store it on our behalf.

Where you connect a bank account, our third-party provider will access and retrieve your bank information from time to time on your behalf for purposes connected with operating the Service (see section 3). We do not receive or store your online banking credentials, and we only access the information reasonably necessary to operate the Service.

While we take reasonable steps to ensure our third-party providers comply with applicable laws, we do not control and are not responsible for the content, practices or privacy policies of websites or services we do not operate.

5. Contract terms

These Terms govern your access to and use of the Service. If you receive an advance from us, that advance is provided under separate contract terms (including any repayments, fees and disclosures). If there is any inconsistency, the contract terms apply to the advance and these Terms apply to your use of the Service.

6. Privacy

Our Privacy Policy (available on our website) explains how we handle personal information. By agreeing to these Terms, you acknowledge the Privacy Policy (as updated from time to time in accordance with applicable law). If there’s any inconsistency about personal information, the Privacy Policy prevails; otherwise, these Terms prevail.

When you create an account and each time you take an advance, you will need to consent to receive marketing from us by email and, where you provide a mobile number, SMS. Our messages will clearly identify us as the sender and include a functional unsubscribe mechanism, allowing you to opt out at any time. We will action unsubscribe requests for our marketing promptly (within 5 business days).

8. Changes to the Terms

We may update these Terms at any time. Changes will take effect immediately upon posting the updated Terms on our website or App, unless otherwise stated.

Where changes are material, we will try to give reasonable notice (for example, in-App or on our website). If you do not agree to the updated Terms, you should stop using the Service; continuing to use the Service after the effective date constitutes acceptance of the updated Terms.

You are responsible for reviewing the Terms regularly to stay informed of any updates.

9. International use

We comply with Australian laws in relation to online activities. You are responsible for ensuring that your use of the Service complies with all applicable laws in your jurisdiction. We do not represent or warrant that the content or functionality of our Service is appropriate or available for use in all jurisdictions.

10. Limitation of liability

To the maximum extent permitted by law, we, our employees, directors, contractors, agents, licensors, suppliers, third-party providers, subsidiaries and affiliates:

  • exclude all warranties, representations and conditions not expressly set out in these Terms, including (without limitation) any warranty that our content or the Service will be accurate, reliable, uninterrupted, or free from errors, omissions, viruses or other harmful components; and

  • are not liable for any indirect or consequential loss, or for loss of revenue, profits, goodwill or data, arising in connection with the Service, unless caused by our own negligence, fraud or wilful misconduct.

You are responsible for implementing appropriate safeguards.

11. Regulatory status and consumer rights

We provide advances that are not regulated under the National Credit Code or the National Consumer Credit Protection Act 2009 (Cth). We do not hold an Australian credit licence in relation to the Service.

Nothing in these Terms excludes, restricts or modifies any non-excludable rights or remedies you may have under Australian law. This includes, where applicable, rights under the Australian Consumer Law and the Australian Securities and Investments Commission Act 2001 (Cth).

12. Indemnity

You agree to indemnify and hold harmless us, along with our employees, directors, contractors, agents, licensors, suppliers, third-party providers, subsidiaries and affiliates, from and against all claims, losses, liabilities, expenses, damages or costs (including reasonable legal costs) arising out of or in connection with your:

  • breach of these Terms;

  • misuse of the Service; or

  • negligent, unlawful, or otherwise wrongful conduct.

This indemnity covers losses we reasonably incur that directly result from the matters above, including third-party claims, and does not apply to the extent caused by our negligence, fraud or wilful misconduct.

13. Service changes and suspension

We may modify, suspend or terminate access to all or part of the Service, including in relation to particular users or groups of users, where reasonably necessary (for example, to comply with law or a regulator, address security or operational risks, prevent fraud or misuse, or perform maintenance). Where reasonable, we will try to give prior notice (for example, in-App or on our website). We may act immediately without notice if required by law or where urgent action is needed to protect the Service or users.

Unless otherwise indicated, all content made available through the Service – including text, graphics, logos, icons, images, audio clips, video, downloads and software – is owned by us or our licensors and content suppliers, and is protected by Australian and international copyright, trade mark and other intellectual property laws.

You may access and use the content on the Service for personal, non-commercial purposes only. You must not reproduce, modify, republish, upload, post, transmit, distribute, or otherwise use any such content without our prior written consent, except as permitted under the Copyright Act 1968 (Cth) or other applicable laws.

We reserve all intellectual property rights not expressly granted in these Terms.

15. Licences

We grant you a limited, non-exclusive licence to access and use our Service for personal, non-commercial purposes. You may not frame or use framing techniques to enclose any trademark, logo or other proprietary information without our express written consent.

16. Security and viruses

We do not warrant or guarantee that any files made available for download through the Service will be free from viruses, worms, Trojans, or other harmful software, code, or components. You are responsible for maintaining appropriate security measures.

17. Account security

You may receive or create a username and password to access certain areas of the Service. You are responsible for maintaining the confidentiality of your username and password. We are not liable for any loss resulting from unauthorised access due to your failure to protect your credentials.

18. Electronic communication and signature

By agreeing to these Terms, you consent to receive communications and documents from us electronically (for example, via email, SMS, in‑App) instead of paper, unless a different form is required by law. You are responsible for maintaining access to those channels and keeping your contact details current. You also consent to the use of electronic signatures and acknowledge that your electronic acceptance (for example, clicking “I agree”) constitutes your legally binding signature.

19. General provisions

Failure to enforce any part of these Terms does not constitute a waiver of any provision or right. Neither the course of conduct between the parties, nor any trade practice, shall modify any provision of these Terms.

If any term is deemed invalid, void, or unenforceable, that term shall be severable and shall not affect the validity or enforceability of the remaining terms. We may assign our rights and obligations under these Terms to any party at any time without notice. All rights not expressly granted are reserved.

20. Complaints and financial difficulty

If you have a complaint or dispute relating to the Service, please contact us so we can try to resolve it. If you are experiencing financial difficulty, please contact us so we can help you with your options.

21. Applicable law

These Terms are governed by the laws of Queensland and the Commonwealth of Australia. The parties submit to the non-exclusive jurisdiction of the courts of Queensland, Australia and the courts entitled to hear appeals from them.
